FHA Loan After Chapter 7 Bankruptcy in Florida

An FHA loan after Chapter 7 Florida buyers can get two years from discharge, sometimes sooner. Here are the rules and what lenders add on top.

FHA is the most forgiving mainstream programme after bankruptcy. The standard wait is two years from discharge, not from filing.

That distinction matters. A case filed in 2023 and discharged in 2024 starts the clock in 2024. Our FHA loan page covers the programme.

The two-year rule

Two years from the discharge date, with clean credit since.

No new derogatory accounts, no late payments on anything reported.

Re-established credit helps. A secured card or a small installment loan paid perfectly demonstrates recovery.

Meet those and you are eligible on FHA's own guidelines.

The exception under twelve months

FHA allows approval between one and two years from discharge in limited circumstances.

You must show the bankruptcy resulted from circumstances beyond your control, such as serious illness or the death of a wage earner.

Job loss alone usually does not qualify. Lenders read this narrowly.

You also need documented recovery and re-established credit. Very few lenders will write it, so ask before you build a plan around it.

Lender overlays are the real barrier

FHA permits two years. Many lenders require three, or a higher credit score after a bankruptcy than they would otherwise accept.

Some will not lend after any bankruptcy for four years regardless.

That is not an FHA rule and it varies by lender.

Chapter 13 works differently

You can qualify while still in a Chapter 13 plan, after twelve months of on-time payments.

You need written permission from the bankruptcy trustee to take on the mortgage.

That is more generous than Chapter 7, which surprises people who assume Chapter 13 is worse.

If a foreclosure was involved

A bankruptcy that included a foreclosure runs two clocks.

FHA generally wants three years from the foreclosure completion, which often ends later than the bankruptcy discharge.

The later date governs. Check the actual foreclosure sale date, not the filing date.

Florida foreclosures move slowly, so the gap between the two dates can be years.

Rebuilding in the meantime

Open a secured card and keep utilisation under 30%. It reports like any other tradeline.

Pay every obligation on time. A single late payment restarts the credibility clock.

Save for closing costs, since reserves offset a thin file meaningfully.

What FHA needs from you

A credit score of 580 for 3.5% down, though most lenders want 620 or more after a bankruptcy.

A written explanation of the bankruptcy, which underwriters do read.

The full discharge paperwork and the schedule of debts.

Two years of steady employment since, or a documented reason for gaps.

The alternatives if you cannot wait

Recent credit event loans compress the waiting period sharply, some as little as one day from discharge.

They cost more in rate and down payment, usually 10% to 25%.

What underwriters look for since discharge

Perfect payment history. A single thirty-day late resets the credibility clock.

Re-established credit, ideally two or three tradelines reporting for twelve months.

Stable employment, or a documented explanation for changes.

Savings, since reserves after closing offset a recovering file more than borrowers expect.

Writing the letter of explanation

Underwriters read these, so write it plainly.

State what happened, when, and what changed since. Two or three paragraphs is enough.

Avoid blaming others and avoid minimising. A clear, factual account reads better than either.

Attach documentation where it supports the account: medical bills, a termination letter, a divorce decree.

Buying sooner in Florida

Prices and insurance have both risen, so waiting has a real cost as well as a benefit.

Run both scenarios: buying now on a recent credit event loan, and buying in a year on FHA.

Sometimes the higher rate now costs less than another year of price movement.

Sometimes it does not. We will run both honestly.

Reaffirmed versus discharged mortgages

If you kept a house through the bankruptcy, whether the mortgage was reaffirmed matters.

A discharged mortgage you continued paying still counts as satisfactory history with most lenders.

A foreclosure that followed the bankruptcy starts a separate, later clock.

Bring the full schedule of debts so the underwriter can see which is which.

Insurance and the Florida file

Premiums have risen enough that debt-to-income now fails files that would have cleared two years ago.

After a bankruptcy your ratio has less room to absorb a high premium.

Quote insurance for the specific address before you go under contract.

It is the most common late surprise in a Florida FHA approval.

Find your discharge date. Everything follows from it.

Pull all three bureau reports and confirm the bankruptcy is reported accurately, since errors are common.

Get an insurance quote for the areas you are considering, because in Florida that line decides more approvals than credit does.
